JOHN TSOHO STRIKES OUT STAY OF PROCEEDINGS APPLICATION BY THE DEFENSE TEAM OF NNAMDI KANU

JOHN TSOHO STRIKES OUT STAY OF PROCEEDINGS APPLICATION BY THE DEFENSE TEAM OF NNAMDI KANU

The presiding judge Justice John Tsoho arrived at the bench at exactly 10 am. The lead counsel of the prosecution team, S.M Labaran, introduced himself and his team, followed by Chuks Muoma who also introduced himself and his team.

At exactly 10.06 am Director Nnamdi arrived at the court. 
The judge read out the application and complained as to why the defense should appeal against his acceptance of masked witnesses. He also said that the application for stay of proceedings shall not be entertained as he put it, that could bring hitches in the case.


Justice John Tsoho while reading the application previously filed by SAN Chuks Muoma, requesting a stay of proceedings pending the outcome of the application filed at the appeal court,  further went on to say that  the applicants ( SAN Muoma) argued that the stay of proceedings is an adjunct to the constitution of the federal republic of Nigeria and cannot stand. But he [John Tsoho] disagreed with the applicants that the stay of proceedings should be granted. He mentioned  that the reason the appeal of yesterday could not hold was because of the conference mandatory for all judges to attend this week, and the corruption case(CCT Trial) of Senate President Bukola Saraki.

Nevertheless, John Tsoho admitted that Kanu's case was filed before that of Bukola Saraki in court but urged him not to regard it as a case of superiority since Saraki's case was given priority. He ruled that the applicant's application shall not be entertained and on that note, he struck out the application. 

So as it stands now, judge John Tsoho has stood his ground that masked witnesses will be entertained at the next hearing of the case to testify against Nnamdi Kanu, irrespective of the fact that his ruling is being challenged against at the court of appeal.

At this point, Justice John Tsoho adjourned the case to the 21st. 22nd. 23rd, and 24th June 2016.

However, as at the time of filing this report, one of the lawyers to Nnamdi Kanu, Barrister Ifeanyi Ejiofor was on his way to file an appeal against today's ruling. Live interview granted Biafra writers by Barrister Ejiofor will be brought to you soon.
